Delhi’s Court grants bail to doctor couple in POCSO case – ET HealthWorld

New Delhi: Rohini Sessions Court Anticipatory bail to one male doctor and regular Bail to one female doctor Who are husband and wife and are accused in a case under various sections of the Indian Penal Code. Indian Penal Code and POCSO Act.

While granting regular bail to the woman doctor recently, Sessions Judge Jitendra Singh said that there was never any complaint against the accused under PNDT or illegal termination of pregnancy.

The accused has cooperated in the investigation by providing all the records. Under these circumstances, the applicant/accused is released on bail, the court said.

The prosecutrix in the case levelled allegations against her lover/co-accused stating that her abortion was performed 3 times in May, October and December 2023 at a doctor’s clinic, on the basis of which the lady gynecologist was arrested by the investigating officer of South Rohini Police Station.

Interestingly, the prosecutrix’s boyfriend got anticipatory bail, but the doctor was arrested by the IO. While the clinic was raided, no evidence of the prosecutrix being pregnant or having an abortion was found.

During the court proceedings, the doctors’ lawyers Ravi Dral and Aditi Dral showed the clinic’s register in which the abortion-related registry entries were made. The gynecologist was granted regular bail due to lack of evidence against the doctor. There was no allegation of abortion against the gynecologist’s husband, who was granted anticipatory bail.

Advocate Aditi Dral argued that the accused has been falsely implicated in this case. It was further argued that the accused is a well-known doctor and she has no idea about the facts or person involved in this case. It was further argued that the accused is around 57 years old, she is a doctor (gynaecologist) by profession and has been working in the said nursing home for the last 15 years. It was further argued that she herself has got the records checked while in police custody. The investigating officer has already collected all the relevant documents, so now there is no need to interrogate her in custody. Advocate Aditi Dral further argued that there is no complaint of illegal abortion or miscarriage against the present accused.

An FIR was registered in the case based on the statement of the complainant, in which she alleged that she was raped multiple times by the co-accused and her abortion was performed at the nursing home of the present accused. (ANI)
